OREANDA-NEWS The draft amendments to the Code of Administrative Offenses (CAO), prepared by the Ministry of Natural Resources, suggests a sharp tightening of penalties for illegal extraction of non-metallic minerals such as sand, crushed stone, coal and peat. In the current version, this activity is punished on a general basis. Fines for individuals who do not have a mining license amount to 3,000-5,000 rubles, for officials — 30-50 thousand, and for organizations — from 800 thousand to 1 million rubles.

The document proposes to introduce a separate article, under which the current maximum fine will become the minimum, it becomes possible to double the fine, and criminal liability is allowed in case of repeated violation.

The agency points out that from 2018 to 2021, for 12 months, the total amount of fines amounted to about 90 million rubles. In 2022-2023, it decreased to 16-17 million.

Officials estimate budget losses from illegal mining at 51-459 million rubles per year. With the help of the new system, the Ministry of Natural Resources expects fees in the amount of 5.4 billion rubles. If the excess turns out to be so much more than the tax savings, then it will be more profitable for black subsoil users to legalize their activities, the agency is confident.

Pavel Grigoriev, senior associate at the Propositum Law Firm, noted that the changes could indeed increase fees to the budget, but the downside would be an increase in the problems of residents of non-gasified regions. Without illegal mining, they will lose access to inexpensive resources to heat their homes.

Earlier, Ilya Seredyuk, Governor of the Kemerovo Region, explained the disappearance of high-grade coal for the population by the crisis in the coal industry. According to him, residents of Kuzbass, the main coal region of the country, traditionally bought fuel at large discounts, and they managed to achieve this with help from the budget and through agreements with suppliers, but there is no longer such an opportunity.
