Norilsk Nickel Continues to Defend Position in Dispute with Rosnedra
OREANDA-NEWS. June 28, 2013. MMC Norilsk Nickel filed an appeal to Federal Commercial Court of the Moscow Region. The Company appeals against the ruling of the Ninth Commercial Court of Appeals voiced, as the ruling was made with numerous violations of substantive and procedural law. The Court refused to reverse the ruling of an inferior court on MMC Norilsk Nickel’s appeal against the Federal Agency on Subsoil Use (Rosnedra).
The Company stands by on invalidating the decision of the bidding commission on the southern part of Norilsk-1 deposit and insists on conducting an independent assessment of tender documents.
The Company underscores that license granting for the southern part of Norilsk-1 deposit to any of the bidding participants is not at the heart of the litigation, but the issue of due process in certain actions and decisions made by Rosnedra in bidding procedure, including the choosing members of the commission and hiring experts to analyze the bidding documents.
Mineral license for the southern part of Norilsk-1 deposits can only be awarded after a newly held auction subject to changes introduced into the Subsoil Law on January 11, 2013.
