Duma Committee supports revolving fines for companies for violations with methanol

OREANDA-NEWS The State Duma Committee on Legislation has supported a bill that proposes to introduce a new article in the Administrative Code and prescribe liability for violations of the rules for handling methanol and methanol-containing liquids, including turnover fines not included in a specially formed register.
Bill No. 732839-8 was submitted to parliament in October 2024 by a group of deputies and senators, including Deputy Speaker of the Federation Council Nikolai Zhuravlev and head of the State Duma Committee on Industry Vladimir Gutenev.
In conclusion, the Committee notes that the bill will help strengthen safety when using methanol. The Committee also suggested considering the comment of the Supreme Court, which proposed that arbitration courts should be given the authority to consider this category along with judges of courts of general jurisdiction.
The Committee also noted that when working on the draft law, it is important to take into account the terminology, the composition of offenses and the timing of its entry into force, so that it coincides with the main industry draft law No. 610892-8 on the regulation of methanol turnover.
The bill being considered by the committee is a "companion" to the bill adopted in the first reading on the introduction of state regulation of the turnover of methanol and methanol-containing liquids from March 1, 2025. According to the main draft law, companies and sole proprietors will have to register in a special register, which will be maintained by the authorized body (it is not defined in the draft law). The registry will include data on manufacturers, sellers, carriers and custodians of methanol. The turnover of methanol between unregistered persons will be prohibited, as well as retail sales.
According to the proposed amendments to the Administrative Code, violation of the rules of turnover by persons from the register entails the imposition of an administrative fine on officials in the amount of 30 thousand to 50 thousand rubles; on legal entities - in the amount of 100 thousand to 150 thousand rubles, with the possibility of confiscation of manufactured products using methanol.
Repeated violation entails the imposition of an administrative fine on officials in the amount of 50,000 to 70,000 rubles; on legal entities - in the amount of 150,000 to 200,000 rubles, with the possibility of confiscation of products.
The turnover of methanol and methanol-containing liquids by persons who were not included in the register of organizations and sole proprietors being formed entails the imposition of a fine on officials in the amount of 500 thousand to 1 million rubles or disqualification for a period of two to three years.; for legal entities - no more than one fifth of the total revenue received from the sale of all goods (works, services) for the calendar year preceding the year in which the administrative offense was detected, but not less than 3 million rubles with the possibility of confiscation of manufactured products or suspension of activities for a period of sixty to ninety days.
The bill also introduces a fine for the illegal trafficking of methanol and an individual in the amount of 30 thousand to 50 thousand rubles with confiscation of manufactured products.
The bill received positive feedback from the Government. At the same time, the government emphasizes that the use of revolving fines will not work against unscrupulous market participants who do not have significant income or assets.
