OREANDA-NEWS. May 31, 2008. Considering a complaint of the "INFORM-SISTEMA" Research and Production Association" CJSC, the Federal Antimonopoly Service (FAS Russia) recognized the rightness of the actions of the Federal Agency for Education (the Ordering Party) in the open bidding for the works on the project "Informational Content of the Electronic Library of Special Literature on Philology", reported the press-centre of FAS Russia.

The Petitioner stated that evaluating the bids in the open bidding, the Ordering Party failed to consider the requirements of the tender documentation that the bidders must have the necessary intellectual property rights, confirmed by appropriate documents (contracts with the authors), and, therefore, violated Article 27 of the Federal Law "On State and Municipal Procurement of Goods, Works and Services".

However, FAS Russia established that the Ordering Party had rightfully allowed the bids without taking into account whether they bidders had had intellectual property rights at the time the bids had been submitted.

Therefore, FAS Russia recognized that the complaint was unfounded.
