OREANDA-NEWS. On January 13, 2009 the Federal Antimonopoly Service (FAS Russia) imposed administrative charges upon "RZhD" OJSC, in the person of East-Siberian Railway, and fined the company 21 990 000 Rubles for concerted actions with "ZapSibCement" Ltd., the Department of Urban Planning and Road Facilities of the Irkutsk region, "Sibirsky Cement" Holding Company" OJSC and the Authority of the Irkutsk region, reported the press-centre of FAS Russia.

Earlier FAS Russia found that the Authority of the Irkutsk region, the Department of Urban Planning and Road Facilities of the Irkutsk region, "Sibirsky Cement" Holding Company" OJSC, "RZhD" OJSC, in the person of East-Siberian Railway, and "ZapSibCement" Ltd. violated Clauses 3 and 4 Article 16 of the Federal Law "On Protection of Competition".

The companies and state authorities violated the law by engaging in concerted actions in September - December 2007, aimed at territorial division of the goods market as well as restriction of the entry of cement consumers, operating outside of the Irkutsk region, to the goods market by concluding a competition-restrictive agreement.

Under Article 14.32 of the Code of the Russian Federation on Administrative Violations, if an economic entity concludes a competition-restrictive agreement, forbidden by the antimonopoly legislation of the Russian Federation, or is engaged in competition-restrictive concerted actions, forbidden by the antimonopoly legislation of the Russian Federation, it is punishable by imposing an administrative fine upon legal entities - from one hundredth to fifteen hundredth of the proceeds gained by the violator from selling goods (works, services) on the market where the violation occurred.

In accordance with Article 14.32 of the Code of the Russian Federation on Administrative Violations, the fine imposed upon "RZhD" OJSC, in the person of East-Siberian Railway, for the administrative violation amounts to 21 990 000 Rubles.

In the FAS Russia's opinion, executing the decision and the determination, issued in follow-up of the decision on the case, will improve competitive environment on the cement market and help stabilizing the situation on the market in the Irkutsk region.
