OREANDA-NEWS. December 16, 2009. To simplify execution of No.583 Decree of the Government of the Russian Federation of 16th July 2009 "On the Cases of Allowability of Agreements between Economic Entities", the Federal Antimonopoly Service devised the flow-chart for preliminary assessment whether the buyer-seller agreements comply with allowability criteria specified in the Decree, reported the press-centre of FAS Russia.

The flow-chart is aimed at business representatives, especially who sell their products through distributors (dealers).

The flow-chart makes assessment of restricting conditions that can be found in "vertical" agreements. Such conditions include: exclusive territory; exclusive buyers served by a distributor; reselling prices that can be fixed by an agreement with a distributor; restrictions that an agreement can impose upon a distributor in terms of possibilities to select the products and suppliers, etc.

The flow-chart helps finding out if the allowability conditions specified in No.583Government Decree "On the Cases of Allowability of Agreements between Economic Entities" apply to particular agreements, and if "yes", then can the agreement be allowed. It determines if participants of such an agreement will be relieved from administrative liability if the antimonopoly authority establishes a competition-restrictive nature of the agreement.

"This flow-chart will enable entrepreneurs to make a preliminary assessment of proposed agreements to verify their compliance with the antimonopoly legislation and arrive to a decision whether such agreements are necessary", said Andrey Tsarikovskiy, Deputy Head of FAS Russia.
