OREANDA-NEWS. June 02, 2011. Moscow Arbitration Court pronounced legitimacy of the FAS Russia’s Order about including “TransContainer” OJSC in the Register of economic entitiesб reported the press-centre of FAS Russia.

Based on the findings of its analytical market report, FAS Russia established that the group of persons, including “Russian Railways” OJSC and “TransContainer” Centre for Container Freight Transportation” OJSC, has dominant market position.

By No.431 Order of 3rd August 2010, FAS Russia included the group of persons, comprising “Russian Railways” OJSC and “TransContainer” Centre for Container Freight Transportation” OJSC, in the Register of economic entities that control over 35% of the market of particular goods under the position:

- “Services for providing universal containers to be used for domestic freight transportation in universal containers by railway transport in general use”, geographic boundaries – the Russian Federation, All-Russian Classifier of the Types of Economic Activities – 60.1, market share - > 50 (as part of the group of persons).

“TransContainer” Centre for Container Freight Transportation” OJSC disagreed with the FAS Russia’s conclusion and filed a lawsuit challenging the FAS Russia’s Order about including the company in the Register.

On 25th May 2011, Moscow Arbitration Court supported the position of the antimonopoly authority and pronounced legitimacy of including “TransContainer” OJSC in the Register of economic entities, which confirmed the dominant market position of the company.
