OREANDA-NEWS. April 02, 2012. The Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan OFAS Russia) asked the Arbitration Court of the Republic of Dagestan to consider possible disqualification of the Managing Director of “Dagestan Power Supply Company” OJSC (“DESK” OJSC), Galip Galipov, reported the press-centre of FAS Russia.  

In 2011, Dagestan OFAS Russia received documents from “Kizilyurtenergosbyt” Municipal Unitary Enterprise confirming the facts of restricting power supply by “DESK” OJSC, “North Caucasus MRSK” OJSC and “Dagenergoset” OJSC in Kizilyurt.

The Commission of the antimonopoly body established that an application for restricting power supply to “Kizilyurtenergosbyt” Municipal Unitary Enterprise was signed by Galip Galipov, and it specified the period of restriction. “Dagenergoset” OJSC and “DESK” OJSC are members of the same group of persons because the functions of a sole executive body “DESK” OJSC are transferred to “North Caucasus MRSK” OJSC, while “Dagenergoset” OJSC is a subsidiary of “North Caucasus MRSK” OJSC.

Dagestan OFAS Russia found that the companies violated Part 1 Article 10 of the Federal Law “On Protection of Competition” by restricting without any economic or technological justification and terminating power supply to consumers of electric power in Kizilyurt.

The Arbitration Court of the Republic of Dagestan pronounced legitimacy of the conclusions made by Dagestan OFAS Russia.

“Part 2 Article 14.31 of the Code of the Russian Federation on Administrative Violation specifies administrative liability for unlawfully initiating power supply restrictions – disqualification for a period of up to three years”, commented the Head of Dagestan OFAS Russia, Kurban Kubasaev.
