Court Took Side of Yakutia OFAS in Dispute with Sakhaneftegazsbyt
OREANDA-NEWS. February 11, 2013. Yakutia Arbitration Court pronounced legitimacy of the decisions of the Office of the Federal Antimonopoly Service in the Sakha Republic (Yakutia) (Yakutia OFAS Russia) on the case of “Sakhaneftegazsbyt” OJSC that in 2011 the company unreasonably fixed different prices for the services of acceptance-warehousing activities and storage of oil products (in breach of Clause 6 Part 1 Article 10 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.
The antimonopoly body of Yakutia discovered that the orders of the General Director of “Sakhaneftegazsbyt” OJSC had fixed different rates for the services of acceptance-warehousing activities and storage for certain market players that revert oil products designated “for the state needs” to reserve stock for agricultural producers, or depending on the location of fuel production. These services were rendered at the price below similar services.
The company disagreed with the decision of the antimonopoly body and filed a lawsuit. The Court, however, dismissed the claim of “Sakhaneftegazsbyt” OJSC.
Olga Yarygina, Deputy Head of Yakutia OFAS Russia commented the Court judgment: “The company’s actions resulted in creating advantages to certain buyers and in infringing the interests of other participants on the market of storage and warehousing oil and petroleum refinery products in the Sakha Republic”.
Также Yakutia OFAS Russia is considering initiating an administrative case against the company upon a fact of abusing market dominance.
