FAS: Institute of Warnings Proved its Value
OREANDA-NEWS. March 13, 2013. At FAS Collegium included a workshop with the Heads of the regional offices of the Federal Antimonopoly Service (FAS Russia) on the pressing issues of the antimonopoly policy. The Head of FAS Legal Department Sergey Puzyrevsky discussed the efforts and efficiency of the warning system, the institute of disqualification, as well as the issue of challenging administrative fines and expanding the database of the persons held administratively liable.
“In 2012 FAS issued around 1500 warnings within the system of the antimonopoly bodies, 75% of the warnings were executed. On the whole, the institute of warnings proved its value and now we are seriously considering expanding its application to other areas”, pointed out Sergey Puzyrevsky.
Today the institute of warnings covers only the violations related to imposing disadvantageous contract conditions upon the counteragents and unreasonably refusing and avoiding concluding the contract (Clauses 3 and 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”), but possibly we will expand it to other Clauses of the Article in abusing market dominance.
The Head of FAS Legal Department also discussed administrative liability of officials, economic entities and the authorities.
Mr. Puzyrevsky also looked at several legislative initiatives of FAS Russia: “We have already submitted to the State Duma a draft law on abolishing notifications to FAS for some transactions on economic concentration; the State Duma will also consider a draft law on introducing changes to Article 178 of the Criminal Code of the Russian Federation and the law on operational-and-investigative activities”, said Sergey Puzyrevsky.
