OREANDA-NEWS. May 23, 2013. The Ministry of Justice of the Russian Federation registered the Administrative Regulations of the Federal Antimonopoly Service for providing state services for drafting and signing in accordance with the decision of the Government Commission for Control over Foreign Investments in the Russian Federation an agreement with a foreign investor, or a legal or a physical person that is included in a group of persons with a foreign investor, on ensuring execution of certain obligations when such foreign investor, or a legal or a physical person, is intended to complete a transaction or establish control over an economic entity of strategic importance for national defence and state security, and for documenting a decision on preliminary approving a transaction or approving establishing control or refusing to grant an approval accordingly in the presence or absence of an agreement signed by a petitioner on executing certain obligations by the petitioner.

The Regulations are approved by No.115/13 FAS Order of 6th March 2013.

The Administrative Regulations describes in detail the standard for providing the state service for drafting and signing an agreement with a foreign investor on ensuring execution of certain obligations when the investor is intended to complete a transaction or establish control over an economic entity of strategic importance for national defence and state security. The Regulations also define the structure, consequence and the time framework for administrative procedures and the requirements to their execution.

The Administrative Regulations will come into force ten days after its official publication in the “Rossiiskaya Gazeta” newspaper.
