Fines for violations for marketplaces and aggregators are being introduced in Russia

OREANDA-NEWS Russian President Vladimir Putin has signed a law introducing administrative liability for operators of intermediary digital platforms for violations, in particular for non-compliance with the rules for placing product cards, unjustified restriction of access to personal account and failure to fulfill duties to consider complaints and disputes on the platform, the relevant document is posted on the official website of legal acts.
An intermediary digital platform is an online service that mediates between different market participants: sellers and buyers, customers and performers, landlords and tenants. These include marketplaces, services for placing ads, ordering services, delivering food, renting housing, etc.
According to the law, for failure by the operator to fulfill the obligation to provide a partner with the opportunity to post information on the platform, the fine for officials will range from 10,000 to 40,000 rubles, for legal entities – from 20,000 to 50,000 rubles.
For failure by the operator to fulfill its obligations to post information on the sale of goods, performance of works, and provision of services addressed to users of the platform in partner cards and to verify this information, a fine of 30-80 thousand rubles is imposed on officials and 50-100 thousand rubles on legal entities. The same penalty is provided for blocking product cards without legitimate grounds.
And the fine for violation by the platform operator of the procedure and conditions for reducing the price of partner's goods at his expense will be from 30 thousand to 80 thousand rubles for officials, and from 100 thousand to 300 thousand rubles for legal entities. The platform operator is also required to notify the seller at least 5 business days in advance of the planned price reduction at his expense and provide a real technical opportunity to prohibit such a discount.
The law also explicitly prohibits the use of any measures of influence against the seller for refusing a discount, whether it is a decrease in rating, deterioration of position in search results, restriction of access or termination of the placement of product cards. Fines of up to 400 thousand rubles are provided for such actions.
Failure by the operator to fulfill its duties to verify information about a person intending to become a partner or owner of an order pick–up point, as well as violation of search results requirements, involves the imposition of a fine on officials in the amount of 30-80 thousand rubles, and on legal entities in the amount of 100-400 thousand rubles.
Restricting the access of a platform partner or the owner of a personal account without legitimate grounds, as well as failure to fulfill the duties of reviewing complaints (resolving disputes) on the platform, involves a fine for officials in the amount of 30 thousand to 80 thousand rubles, for legal entities – from 100 thousand to 500 thousand rubles.
