OREANDA-NEWS The Ministry of Justice of the Russian Federation has submitted for discussion draft laws concerning the creation of a Unified state register of enforcement Documents, which will simplify the process of their presentation, as well as reduce the burden on bailiffs, according to the agency's website.
"The Russian Ministry of Justice has developed and posted for public discussion a number of draft laws aimed at creating and ensuring the operation of a fundamentally new system for the enforcement of judicial acts and acts of other bodies – the Unified State Register of Executive Documents," the report says.
The Ministry of Justice's website clarifies that all necessary information will be collected in a single electronic database, and executive documents will be generated exclusively in electronic form and signed with an enhanced qualified electronic signature.
The presentation of each document for execution will be recorded in the registry. Recoverers and debtors will be able to monitor the document execution process using the Gosuslugi portal. In addition, it will be possible to submit an enforcement document to the bank, the employer and the bailiff through a personal account on the Gosuslugi portal. At the same time, the opportunity to apply for the execution of the executive document directly to the relevant body or organization will be preserved.
"The transition to the registry model of enforcement will simplify for citizens and legal entities the process of submitting enforcement documents for execution and reduce the number of personal contacts between the parties to enforcement proceedings and bailiffs. In addition, due to the transition to the registry model, while increasing the efficiency and efficiency of the execution of judicial acts and acts of other bodies, the burden on bailiffs will be reduced," the agency's website says.
Unlike the database of enforcement proceedings of the FSSP of Russia, access to information from the register will be provided to a limited number of persons involved in the execution of a specific document. In addition, when developing the registry, mechanisms are provided for preventing fraudulent actions using executive documents.
