OREANDA-NEWS. June 08, 2008. The Moscow Arbitration Court confirmed validity of the decision and determination of the Federal Antimonopoly Service (FAS Russia) regarding violations of the Federal Law "On Advertising" by "Spektr" Ltd., reported the press-centre of FAS Russia.

"Spektr" Ltd. demonstrated on the streets of Moscow and on the central TV channels (NTV, TNT) an advertisement using the "Technosila" trademark (the advertiser - "Spektr" Ltd.) The advertisement showed various products at a certain price, accompanied by the text using a man's name and the words "... fool! Bought more expensive "("Sanyok is a fool! Bought more expensive ", "Andryukha is a fool! Bought more expensive", etc.).

Taking into consideration the findings of a sociological survey on consumer attitude towards the advertisement and the opinion of the Expert Council on Enforcing the Advertising Legislation, FAS Russia found the advertisement improper and violating Clause 4 Part 4 Article 5 of the Federal Law "On Advertising". The advertisement created a negative attitude towards the persons that do not use the advertised goods. FAS Russia issued a determination requesting that the advertiser - "Spektr" Ltd. - should stop violating the legislation of the Russian federation on advertising.

Clause 4 Part 4 Article 5 of the Federal Law "On Advertising": advertisements must not create a negative attitude towards persons that do not use the advertised goods or criticize such persons.

"Spektr" Ltd. appealed against the decision and determination, issued by the antimonopoly authority, to a court of law.

On 19th May 2008, the Moscow Arbitration Court dismissed the appeal of "Spektr" Ltd. and confirmed validity of the FAS Russia's decision and determination.
