OREANDA-NEWS. October 23, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that "TOK" CJSC violated the antimonopoly legislation, reported the press-centre of FAS Russia.

The company breached the law by fixing and maintaining monopolistically high prices for aviation kerosene sold by "TOK" CJSC to consumers - air carriers in "Yuzhno-Sakhalinsk" airport. The company also refused without any technological reasons to enter into the contract with "Vladivostok Avia" OJSC for intake and storage of company's aviation fuel.

Clause 1 Part 1 Article 10 of the Federal Law "On Protection of Competition" prohibits fixing and maintaining monopolistically high prices by economic entities that have dominant market position.

Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition" prohibits economic entities that have dominant market position to refuse without any economic or technological refuse or evade to conclude contracts with individual buyers (clients) if the relevant goods can be produced or supplied and if such refusal or evasion are not directly specified by the federal laws, normative legal acts by the President of the Russian Federation, the Government of the Russian Federation as well as the authorized federal executive bodies or judicial acts.

The amount of fine (10 542 470 Rubles) was determined in accord with Article 14.31 and Clause 3 Part 1 Article 3.5 of the Code of Administrative Violations.
