OREANDA-NEWS. January 15, 2014. In the 5 years of enforcement of No.57-FZ Federal Law “On the Procedures of Foreign Investments in the Business Entities of Strategic Importance for the National Defence and State Security”, the Federal Antimonopoly Service (FAS Russia) received 324 petitions.

The Government Commission for Control over Foreign Investment in the Russian Federation considered 171 petitions out of those received by FAS and granted 162 decisions on preliminary approvals (43 – with imposed obligations) while 9 petitions were refused.

112 petitions were returned as not requiring preliminary approvals; 36 were withdrawn by the petitioners due to changed intentions to pursue the planned transactions, and 5 petitions are being processed.

“The number of transactions by foreign investors with strategic companies considered by the Government Commission since No.57 Federal Law came into force confirms that the existing mechanism for approving such transactions is sufficiently transparent and liberal and the investment climate is attractive. It is enough to see the impressive list of the largest transactions that passed the Government Commission”, pointed out the Head of FAS Department for Control over Foreign Investments, Armen Khanayan.

The largest transactions by foreign investors include:

1. “Danone” (France): concerning “Unimilk” (dairy products)

2. “Pepsi Cola” (USA): concerning “Wimm-Bill-Dann” (dairy products, juices)

3. “Coca Cola” (USA): concerning “Nidan Juices” (juices, beverages)

4. “Alstom” (France): concerning “Tver Coach Building Works” and “Bryansk Machine-Building Works” (rolling stock manufacturing)

5. “AgustaWestland” (Italy): concerning “HeliVert” (manufacturing helicopters and helicopter engines)

6. “Changi” (Singapore): concerning airports in such cities as Anapa, Sochi, Krasnodar

7. Schneider Electric (France): concerning “Electroschield” (production of electrical equipment)

8. “Liebherr” (Switzerland): concerning “Liebherr-Aerospace” (Nizhny Novgorod) (manufacturing air components)

9. Global Ports (Cyprus, Denmark) concerning “First Container Terminal” CJSC

10. “Total” (France) and “China National Oil and Gas Exploration and Development Corporation” concerning “Yamal SPG” OJSC.

Based on the outcome of the last meeting of the Government Commission on 13th November 2013, FAS issued preliminary approvals of the following petitioned transactions:

1. “Liebherr-Aerospace Russland” Ltd.: concerning “Liebherr-Aerospace Nizhny Novgorod” Ltd.

2. “China National Oil and Gas Exploration and Development Corporation”: concerning Yamal SPG” OJSC

3. “T.S. TRANS SIBERIA CO LIMITED”: concerning “Volgograd International Airport” OJSC

4. “Global Ports Investments PLS”: concerning “First Container Terminal” CJSC.
