Russian Railways Execute FAS Determination
OREANDA-NEWS. The Federal Antimonopoly Service (FAS Russia) found that actions of “Russian Railways” OJSC had signs of violating the antimonopoly law (Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”). The company refused to send empty cars to Surgut Railway Station in the absence of statutory prohibitions. FAS issued a warning to the company to eliminate those elements of violation by adjusting railway waybills in line with the law and issuing explanations on the procedures for concluding contracts to the network of “Russian Railways” OJSC.
To execute the warning, on 21st February 2014 “Russian Railways” OJSC sent a flowing telegram of 17th February 2014 to the regional centres for branded transport services:
Interacting with the users of railway services with regard to shipping paperwork and accepting private empty cars for shipping, the Heads of the regional centres for branded transport services should:
1) Ensure compliance with the current legislation, particularly, No. 258 Order of the Ministry of Transport of the Russian Federation “On Introducing Changes to Some Acts of the Ministry of Transport of the Russian Federation” of 3rd October 2011
2) Prevent derogations from the procedures of cooperation with the users of railway transportation services provided for by the current legislation.
