OREANDA-NEWS  Anapa authorities have increased their claims against the owners of the tankers Volgoneft-239 (owned by Volgatransneft CJSC) and Volgoneft-212 (owned by Kamatransoil LLC), which crashed in the Kerch Strait in December 2024, in terms of collecting expenses for the elimination of the oil spill, an Interfax correspondent who was present said. at the court session.

The plaintiff filed a motion to clarify the claims from 545.93 million rubles to 669.2 million rubles in connection with the payment of municipal contracts for the elimination of the consequences of the emergency, including VAT.

"We believe that we are lawfully collecting this amount, since, in accordance with the 44th law, we fully paid the price of the contract (to eliminate the consequences of the emergency) without any deductions," said a representative of the plaintiff.

The court returned the petition to the plaintiff for revision and clarification of the requirements.

The insurance company Absolut-Insurance has attached to the case file a conclusion based on the results of research of the plaintiff's documents.

"Experts have made a conclusion in which we base our objections to quantifying costs on the unreliability and insufficiency of documents, the lack of objective recording of work results, and the costs for most of the work that are not presented. In other words, this is an expert opinion on the verification of those documents that were submitted by the plaintiff in April 2025. We would also like to draw attention to the fact that the plaintiff does not provide complete reliable information to verify the cost of the work. The experts said they couldn't check objectively because there weren't enough documents for withdrawal," said a company representative.

As previously reported, Absolut Insurance is involved as a third party that does not make independent claims. A representative of Volgatransneft filed a corresponding petition, specifying that the company insured the liability of the owner of the sunken vessel.

A representative of the VSK insurance company (the insurer of the Volgoneft-212 tanker) stated that the plaintiff did not provide a legal position on why VAT amounts are subject to accounting.

"Additionally, the primary documentation is presented, they contain evidence of the completion and acceptance of work with municipal contracts. The plaintiff has attached new municipal contracts that are not included in the specified claims. The plaintiff did not substantiate in any way the requirements for the recoverable value of the purchased special equipment in full, taking into account the possibility of its use for other purposes after the elimination of the consequences of this man-made disaster. And the plaintiff still did not specify the size of the claims against each of the defendants," said the representative of the VSK.

As a result, the court session was adjourned until November 27, 2025 to clarify the merits of the claims.

On December 15, 2024, fuel oil tankers Volgoneft-212 and Volgoneft-239 crashed in the Kerch Strait, resulting in a fuel spill. According to the Ministry of Transport of the Russian Federation, four tanks with petroleum products were damaged in the crash.

Regional emergency regimes have been introduced in the Krasnodar Territory, Crimea and Sevastopol, and a federal emergency regime is also in effect.

The commissions of Rostransnadzor, the Ministry of Transport of Russia and Rosmorrechflot identified among the main causes of the crash the failure of ship captains and shipowners to comply with restrictions on the season of navigation of vessels in the sea of the Sea of Azov and the Kerch Strait. In addition, the crews of the vessels were not staffed with qualified personnel in accordance with the legal acts of the Ministry of Transport of Russia.

Rosprirodnadzor estimated the damage caused by the fuel oil spill in the Kerch Strait at almost 85 billion rubles and filed lawsuits with the Arbitration Court of the Krasnodar Territory. The sum of the calculated damage in respect of LLC Kama Shipping (the charterer of the vessel Volgoneft-212) and LLC Kamatransoil (the owner of Volgoneft-212) jointly amounted to 49.46 billion rubles. The amount of damage to be reimbursed to Volgatransneft CJSC (owner of the Volgoneft-239 tanker) is 35.48 billion rubles.
