OREANDA-NEWS. On June 09, 2007 the Government of the Russian Federation adopted № 359 Resolution "On Approving the Conditions of Recognizing the Dominant Position of a Financial Organization (excluding credit organizations) and the Rules of Establishing the Dominant Position of a Financial Organization (excluding credit organizations"), reported the press-centre of  FAS Russia.

The Resolution was devised in line with Part 7 Article 5 of the Federal Law "On Protection of Competition" to enable the antimonopoly authority exercising its powers on establishing the dominant position of an economic entity for the purposes of consideration of the antimonopoly cases or state control over economic concentration.

The Conditions determine that the dominant position of a financial organization (a group of persons) can be recognized only if throughout a long period of time the financial organization (the group of persons) in question has controlled over 10% market share on the only market in the Russian Federation or 20% share of a market, if the goods also circulate on some other goods markets of the Russian Federation, provided the existing competitors have considerably smaller market shares.

The Rules set the procedures and stages of establishing the dominant position of a financial organization as well as specify the criteria used for calculating the market share of a financial organization.

The Rules and Conditions are not applicable for establishing the dominant position of a credit organization involved in banking operations.
