OREANDA-NEWS. On October 29, 2007 the Federal Antimonopoly Service (FAS Russia) found that Rospotrebnadzor [The Federal Consumer Protection and Human Welfare Agency] violated Part 1 Article 15 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

The case was initiated upon the petition of the General Director of "ZapSibSyr" Ltd.

Rospotrebnadzor violated the law by issuing a Letter "On the System of Facultative Certification of Dietary Supplements".

The Letter issued by Rospotrebnadzor eliminated a possibility to undergo facultative certification using other systems of facultative certification, except the one approved by Rospotrebnadzor, which violated the principle that coercion towards facultative certification.

Implementing the provisions of the Rospotrebnadzor's Letter "On Improved Supervision of the Dietary Supplements Turnover" can result in preventing, restricting or eliminating competition on the market of production and sales of dietary supplements.

Having considered the case, FAS Russia opted to avoid issuing a determination as Rospotrebnadzor voluntarily eliminated the antimonopoly violation by issuing a new letter that declared the disputed letter null and void and also provided for facultative certification of dietary supplements using any of properly registered systems of facultative certification of dietary supplements.
