OREANDA-NEWS. May 31, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Moscow Department of Nature Management and Protection of the Environment (the Ordering Party) violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" in an open auction for the governmental contract for the works on publishing the "Ecograd" magazine, which covers the issues of nature management and protection of the environment in 2008, reported the press-centre of FAS Russia.

The case against the Department was initiated under the complaint of "Golden B" CJSC.

According to the Petitioner, the Ordering Party wrongfully refused to allow the Petitioner's bid on the grounds that the document, which confirmed depositing funds as collateral for the bid, was not duly prepared.

However, FAS Russia established that the document was in compliance with the current legislation of the Russian Federation.

FAS Russia recognized that the complaint was justified and issued a determination to the department requesting it to eliminate the violations of the Federal Law "On State Procurement…", namely: to withdraw the Bids Pre-Qualification Protocol and repeat the bids pre-qualification procedure according to the Federal Law "On State Procurement…".

In addition, FAS Russia intends to initiate an administrative case against the Ordering Party under Part 2 Article 7.30 of the Code of Administrative Violations.
