OREANDA-NEWS. June 03, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Department of Internal Affairs in the Tula region (the Ordering Party) violated Part 2 Article 12 and Part 4 Article 25 of the Federal Law "On State and Municipal Procurement of the Goods, Works and Services" in an open bidding for the governmental contract for the mandatory life and health insurance services of the soldiers and officers of the Department of Internal Affairs in the Tula region, financed with the regional budget for 2008, reported the press-centre of FAS Russia.

The case against the Tula Regional Department of Internal Affairs was imitated under the complaint of "MAKS" CJSC. According to the Claimant, the Tender Commission wrongfully refused to accept the company's bid on the grounds that it failed to meet the requirements specified in the tender documentation.

However, FAS Russia established that the bid of "MAKS" CJSC was in compliance with the tender documentation.

Moreover, the tender documentation stated that the bids should have contained documents and information, not required under the Federal Law "On State Procurement …".

In this context, FAS Russia recognized that the Tula Regional Department of Internal Affairs violate the Federal Law "On State Procurement …" and issued a determination to eliminate the violations, namely: to withdraw the Bids Opening Protocols, to amend the tender documentation to comply with the Federal Law "On State Procurement …" and amend the procurement procedures in accordance with the Law.

The Antimonopoly Service initiated administrative proceedings against officials of the Ordering Party (Parts 2 and 4 Article 7.30 of the Code of Administrative Violations).
