OREANDA-NEWS. October 01, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Federal Migration Service violated the Federal Law "On State and Municipal Procurement of Goods, Works and Service" in open tender for the works on developing a set of software and hardware tools "Forced Migrants", reported the press-centre of FAS Russia.

The case was initiated upon a petition of "RDTeCh" CJSC.

In its complaint the Petitioner stated that the Ordering Part had included in the tender documentation an unlawful recruitments to the bidders qualification, and the tender commission was not objective and breached the law scoring the bids in the bids evaluation and comparison procedure.

FAS Russia found the complaint of "RDTeCh" CJSC groundless.

However, the inspection organized by FAS Russia revealed that the Ordering Party had violated Part 4 Article 25 of the Law by including in the tender documentation the requirements on price calculation and breakdown of the total government contract price by the type of works.

As the revealed violation had not affected the commission's decision on bids pre-qualification and on shortlisting the bidders, as well as determining the winner, FAS Russia did not issue a determination.

FAS Russia will also consider possibility of initiating an antimonopoly case.
