OREANDA-NEWS. December 01, 2008. The Federal Antimonopoly Service (FAS Russia) imposed an administrative fine 40000 Rubles upon Berlin-Chimie/Menarini Pharma GmbH (a German share-holding company with limited liability that has its representative office in the Russian Federation " Berlin-Chimie/Menarini Pharma GmbH" Ltd. (Germany) for unfair advertising of "Prostamol Uno", reported the press-centre of FAS Russia.

On 21st September 2008, FAS Russia found that the advertisement of "Prostamol Uno"was unfair and violated Part 7 Article 5 of the Federal Law "On Advertising". The advertisement was broadcasted in August - December 2008 on "NTV" and "Sport" TV channels and contained the expressions: " Prostamol UNO. Treatment of prostatitis and prostate adenoma", "Prostamol. Simply be a man".

The expression "Treatment", used in the advertisement, states possibility of affecting the patient's body using both nosotropic and symptomatic methods. At the same time "Prostamol Uno" is used for only one type of treatment - symptomatic. Therefore, the advertisement did not have important information on the method used for the treatment with this drug.

Under Part 6 Article 38 of the Federal Law "On Advertising", the advertiser is liable for violations of Parts 2-8 Article 5 of the Federal Law. FAS Russia issued a determination to the advertiser - Berlin-Chimie/Menarini Pharma - to stop violations of the advertising.

Part 7 Article 5 of the Federal Law "On Advertising" prohibits advertisements that do not contain some important information on the advertised goods, conditions of their purchasing or usage, if it distorts the content of information and misleads the consumers of the advertisement.
