OREANDA-NEWS. December 18, 2008. The Moscow Arbitration Court dismissed the claim of the Federal Customs Service (FTS Russia) and confirmed legitimacy and relevance of the decision and determination issued by the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.

Earlier FAS Russia found that the Federal Customs Service had violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations.

The case was initiated upon a petition of the "Nuclear Physics Research" Research and Development Centre" Federal State Unitary Enterprise. The Petitioner Stated that FTS Russia had violated the state procurement legislation in an open bidding for supply and commissioning stationary radiation control systems.

Investigating the case, FAS Russia found that the Ordering Party had violated Article 10 of the Federal Law "On State and Municipal Procurement of Goods, Works and Services". Governmental contracts for goods, works or services, included in the Russian National Classifier of Economic Activities, must be concluded by bidding in the form of an auction. The Ordering Party, however, organized the bidding in the form of an open tender.

The Court confirmed the rightness of the position of the Antimonopoly Service.
