OREANDA-NEWS. February 04, 2009. The Federal Antimonopoly Service (FAS Russia) welcomes the ruling of the Presidium of the Supreme Arbitration Court (VAS), according to which the Customs is allowed to confiscate only counterfeit goods. Article 14.10 of the Code of the Russian Federation on Administrative Violations (CоАP) must not be applied to the original goods imported to the Russian Federation, reported the press-centre of FAS Russia.

"We are grateful to the Presidium of the Supreme Arbitration Court for this important decision. It is aimed at developing competition in Russia", said Igor Artemyev, the Head of FAS Russia.

Earlier FAS Russia already stated that bona fide buyers, supplying original assignors' goods, legally commercialized abroad, to Russia must not be restricted in their economic activities.

Unlawful use of someone else's trademarks, service marks, appellations of origin or similar marks for homogenous goods offices is punishable by imposing an administrative fine upon physical persons - from 1500 to 2000 Rubles with confiscation of the objects that illegally reproduce the trademark, service mark, or appellations of origin; upon company executives - from 10000 to 20000 Rubles with confiscation of the objects that illegally reproduce the trademark, service mark, or appellations of origin; and upon legal entities - from 30000 to 40000 Rubles with confiscation of the objects that illegally reproduce the trademark, service mark, or appellations of origin.
