OREANDA-NEWS. May 25, 2009. Federal Antimonopoly Service (FAS Russia) found that the Ministry of Health Care and Social Development of the Russian Federation violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.

The case was initiated upon a petition of "LOKOENGINEEING" Ltd. The Petitioner stated that the Ministry of Health Care and Social Development of the Russian Federation violated the Federal Law in organizing an open auction for supplying buses for the needs of agencies subordinate to the Ministry of Health Care and Social Development of the Russian Federation. The auction was organized to implement the instructions of the Government of 9th February 2009 for No.1 lot "Small-size passenger bus" and No.4 lot "Passenger bus for transportation of handicapped".

According to the Petitioner, in breach of Part 3.1 Article 34 of the Federal Law "On State and Municipal Procurement of Goods, Works and Services", the technical section of the auction documentation includes technical specifications for the equipment to be supplied, whose full combination does not match any small-size buses available on the market of the Russian Federation, which limits the number of participants. Also the technical requirements to the equipment, formulated for No 4. lot, in their totality unequivocally define the model of the buses to be supplied as "Volzhanin - 6216". Thus, actions undertaken by the Ordering Party restrict competition, which contravenes the law on state procurement.

Having investigated the case, FAS Russia found the complaint of "LOKOENGINEEING" Ltd. justified because the Ordering Party such recruitments to the equipment that limit the number of the auction participants, and issued a determination to eliminate the violations.
