OREANDA-NEWS. August 07, 2009. The St Petersburg Office of the Federal Antimonopoly Service (OFAS Russia) found that "Peterburgskaya Energosbytovaya Kompania" OJSC violated Article 10 of the Federal Law "On Protection of Competition". The company evaded signing an Agreement on information exchange and the List of measurement devices for the purposes of commercial accounting at the delivery outlets (the Agreement and the List) with "Transneft'service" Ltd., reported the press-centre of FAS Russia.

The Agreement and the List, agreed upon by adjacent participants of the wholesale market, are mandatory for an energy supplier to operate in the wholesale market of electric energy and power.

Planning to supply electric energy from the wholesale market of electric energy and power, "Transneft'service" Ltd. forwarded the Agreement and the Lists to "Peterburgskaya Energosbytovaya Kompania" OJSC, the adjacent participant of the wholesale market.

Under Clause 8 of the Rules of Non-Discriminatory Access to the Services of the Wholesale Market Administrator Providing those Services, и оказания этих услуг, adjacent participants of the wholesale market are obligated to agree upon the documents on commercial accounting of electric energy, information exchange and the procedures for using measurement devices within thirty days after the relevant documents were received.

In breach of the designated period, "Peterburgskaya Energosbytovaya Kompania" OJSC agreed upon and forwarded the Agreement and the Lists to "Transneft'service" Ltd. only after four months.

Delays in signing the above documents by "Peterburgskaya Energosbytovaya Kompania" OJSC restricted competition on the market of buying-and-selling electric energy, infringed the interests of "Transneft'service" Ltd. and deprived "Transneft'service" Ltd. of a possibility to supply electric energy from the wholesale market of electric energy and power in 2009.
