OREANDA-NEWS. January 15, 2010. The Federal Antimonopoly Service (FAS Russia) directed an enquiry to "EnergoStream" Ltd. to verify information published on 11th January in mass media. In particular, the article in question says that "EnergoStream" Ltd. bought shares of "Buryatenergosbyt" OJSC, "Omsk Energy Supplier [Omskaya Energosbytovaya Kompania]" OJSC, "Tomsk Energy Supplier [Tomskaya Energosbytovaya Kompania]" OJSC and "Chita Energy Supplier [Chitinskaya Energosbytovaya Kompania]" OJSC. The article also contains statements made by a company representative that it is not necessary to seek approval of those transactions by the antimonopoly authority, reported the press-centre of FAS Russia.

The Federal Law "On Protection of Competition" provides for the cases when transactions (actions) with stock (shares) of commercial organizations must be approved by the antimonopoly body, or the antimonopoly body must be notified about completing such transactions.

FAS Russia holds a tentative opinion that if the transactions mentions in the article were effectively completed, they can come under the provision of the Federal Law "On Protection of Competition", which requires preliminary approval or notification of the antimonopoly authority. The final conclusions will be made after FAS Russia obtains information and relevant documentation from "EnergoStream" Ltd.

By the laws of the Russian Federation, failure to present information requested by the antimonopoly body in due time, as well as presenting unreliable information bears administrative liability.
