OREANDA-NEWS. February 05, 2010. The Federal Antimonopoly Service (FAS Russia) terminated the proceedings against the Ministry of Transport of the Russian Federation due to voluntary elimination of the antimonopoly violations by the Ministry, reported the press-centre of FAS Russia.

The case against the Ministry of Transport was initiated upon the signs of violating Part 1 Article 15 of the Federal Law "On Protection of Competition".

In Clause 2 of No.189 Order of 17th December 2007 "On Approving the List of Harbour Dues in the Sea Ports the Russian Federation", the Ministry of Transport specified that piloting and environmental dues are charged by "Rosmorport" Federal State Unitary Enterprise, although piloting and environmental services are provided by other piloting and environmental organizations operating in the sea ports.

In addition the Order of the Ministry of Transport of the Russian Federation infringed the interests of private enterprises competing with the enterprises subordinate to the Ministry and the Federal Agency for River and Marine Transport (Rosmorrechflot) - "Rosmorport" Federal State Unitary Enterprise and "Hydrographic Enterprise" Federal State Unitary Enterprise. The Order also restricted market entry for other economic entities.

At a meeting of the FAS Russia's Commission, the Ministry of Transport submitted No.219 Order of 30th November 2009 "On Introducing Changes to No.189 Order of the Ministry of Transport of 17th December 2007", registered with the Ministry of Justice of the Russian Federation on 22nd December 2009.

The Commission found the documents submitted by the Ministry of Transport sufficient to close the antimonopoly case due to voluntary elimination of the violation of the Federal Law "On Protection of Competition".

FAS Russia did not issue a determination to the Ministry of Transport of the Russian Federation.
