OREANDA-NEWS. May 26, 2010. The Federal Antimonopoly Service (FAS Russia) imposed administrative charges upon "Novorossiysk Grain Terminal" OJSC and fined the company 10,447,064 Rubles, reported the press-centre of FAS Russia.

Earlier FAS Russia found that "Novorossiysk Grain Terminal" OJSC, a member of the group of persons comprising "Novorossiysk Grain Terminal" OJSC and "Novorossiysk Commercial Seaport" OJSC, violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing market dominance).

The FAS Russia's Commissions established that the group of persons comprising "Novorossiysk Grain Terminal" OJSC and "Novorossiysk Commercial Seaport" OJSC has dominant position on the market of export grain shipment within the boundaries of deep-water ports in basin of the Azov and Black Seas.

Having analyzed competition environment on this market, FAS Russia discovered that the market share of the group of persons exceeds 50%; in 2009 the tariff initially set at 425 Rubles per ton increased to 470 Rubles per ton, and then to 550 Rubles per ton.

The company was held administratively liable under Article 14.31 of the Code of the Russian Federation on Administrative Violations because as an economic entity that has dominant position on the relevant market it exercised actions recognized as abuse of market dominance and prohibited by the antimonopoly legislation.
