OREANDA-NEWS. February 14, 2011. The FAS Russia’s Commission on investigating the antimonopoly case found that the Federal Air Transport Agency (Rosaviatsia) and the Federal Agency for State Property Management (Rosimuschestvo) violated Clause 2 Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

Since 2003 “Domodedovo” airport has been undergoing reconstruction of No.1 runway, taxi lanes and aircraft parking space under the Federal Target Programme “Modernization of the Transport System in Russia (2002 – 2010)”. The reconstruction works are funded by state capital investments and are included in the List of state federal constructions sites and facilities.

A mandatory condition for continuing reconstruction works on No.1 runway is demolishing real property facilities in federal property that are positioned in the reconstruction zones. To demolish real property facilities, it is necessary to obtain consent of Rosaviatsia as the specialised government agency supervising “Domodedovo” Airport Administration” Federal State Unitary Enterprise and a subsequent consent of Rosimuschestvo, which is authorised to manage state real property.

Having investigated the case, the FAS Russia’s Commission concluded that Rosaviatsia and Rosimuschestvo violated Clause 2 Part 1 Article 15 of the Federal Law “On Protection of Competition” by refusing in July 2007 – September 2010 to issue permission to demolish and write off real property facilities as part of the Federal Target Programme.

In course of the case investigation, the Federal Air Transport Agency and the Federal Agency for State Property Management voluntarily eliminated the violations exposed by the antimonopoly authority.

Under Part 1 Article 15 of the Federal Law “On Protection of Competition”, federal executive bodies cannot pass acts and (or) exercise actions (omissions) that lead or can lead to preventing, restricting or eliminating competition, except when adopting such acts and (or) exercising such actions (omissions) are provided for by the federal laws; in particular, unreasonably preventing activities of economic entities is prohibited (Clause 2).
