OREANDA-NEWS. July 15, 2011. The Office of the Federal Antimonopoly Service in the Republic of Buryatia (Buryatia OFAS Russia) found that “Buryatnefteproduct” OJSC created discriminatory conditions on retail market of motor petrol and diesel fuel for economic entities, particularly, within the boundaries of Severobaikalsk (violating Clause 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.

“Buryatnefteproduct” OJSC will be issued a determination to eliminate the antimonopoly violation.

The case against “Buryatnefteproduct” OJSC was initiated on 6th May 2011 upon complaints from owners of independent service stations that they were experiencing restrictions in small wholesale sale of oil products.

“Buryatnefteproduct” OJSC has dominant position on retail market of oil products within the boundaries of the Republic of Buryatia and is included in the Register of economic entities that have more than 35% on the market of particular goods.

According to the analysis of the state of competition on this market, carried out as part of the case investigation, the market share of “Buryatnefteproduct” OJSC is over 50% for all types of motor petrol and diesel fuel.

Thus, “Buryatnefteproduct” OJSC can exercise decisive influence upon general conditions of circulation of goods on the relevant market, and (or) push other economic entities away from this market, and (or) prevent entry of other economic entities to this market.
