OREANDA-NEWS. September 23, 2011. The Office of the Federal Antimonopoly Service in the Republic of Komi (Komi OFAS Russia) stopped proceedings against “No. 9 Regional Generating Company” OJSC (“TGK-9” OJSC), reported the press-centre of FAS Russia.

Earlier Komi OFAS Russia initiated a case against “TGK-9” OJSC upon the signs of violating Part 1 Article 10 of the Federal Law “On Protection of Competition”.

The case was initiated upon a petition of a homeowners association from Ukhta – “8, Neftyannikov Embankment”. In April 2010, the homeowners association concluded a power supply contract with “TGK-9” OJSC. When the bills for the services were sent and the sums were allocated between the homeowners, they noticed that the rates for hot water were higher that the ones set by the Tariff service for Ukhta: in 2010 – by 10 %, in the first six months of 2011 by 15.1 %.

Calculating payments of the homeowners association for hot water, the heating supplier used two tariffs – for cold water and for heating up the water. House meters measured the consumed resources. Investigating the case, the Tariff Service explained that in case of centralised hot water supply the payments must be calculated according to the tariff for hot water, rather than using two tariffs. Before the case was finalised the company already recalculated the payments for the homeowners association.

“TGK-9” OJSC voluntarily eliminated the antimonopoly violation and its consequences. Therefore OFAS closed the case and the case materials will be analysed by the antimonopoly body in order to hold “TGK-9” OJSC and a guilty company executive administratively liable”, explained Deputy Head of Komi OFAS Russia, Ms. Tatiana Mikhailova.
