OREANDA-NEWS. July 05, 2012. The Government of the Russian Federation signed No. 631 Decree to assign responsibilities to the Federal Antimonopoly Service (FAS Russia) for enforcement No.223-FZ Federal Law “On Procurement of Goods, Works, Services by Certain Types of Legal Entities”, reported the press-centre of FAS Russia. 

In particular, FAS is authorized to define an aggregate share of participation of the Russian Federation, constituent territories of the Russian Federation, and municipalities in equity capital of economic entities, an aggregate share of legal entities in the equity capital of subsidiaries of economic entities, an aggregate share of participation of subsidiaries of economic entities in equity share of their subsidiaries.

The antimonopoly body will also be enforcing the procedures for notifying customers about changing an aggregate share of such participation.

FAS is also assigned the function for keeping the Register of Unfair Suppliers under the Federal Law “On Procurement of Goods, Works, Services by Certain Types of Legal Entities”.

No.223-FZ Federal Law “On Procurement of Goods, Works, and Services by Certain Types of Legal Entities” took effect on 1st January 2012. The Law establishes the general principles of procurement of goods, works, services, particularly, by state-owned corporations and companies, federal state unitary enterprises and economic entities, if a share of state participation in equity capital of such entities exceeds 50% (customers).
