OREANDA-NEWS. March 25, 2010. "Znamya" Moscow Machine-Building Plant" OJSC transferred a 1,185,390 Rubles fine to the budget for violating the antimonopoly law.

"Znamya" Moscow Machine-Building Plant" OJSC produces components to military and civil aviation equipment.

Earlier FAS Russia established that "Znamya" Moscow Machine-Building Plant" OJSC evaded a contract with "256 ARZ" OJSC for supplies of components for hydraulic systems of helicopters with economic or technological reasons (violation of Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition").

The Antimonopoly Service issued a determination to "Znamya" Moscow Machine-Building Plant" OJSC to eliminate the antimonopoly violations by signing a contract with "256 ARZ" OJSC for supplies of components necessary to repair "Mi" helicopters.

Within the statutory period "Znamya" Moscow Machine-Building Plant" OJSC presented documents to FAS Russia confirming execution of the determination.

Under Article 14.31 of the Code of the Russian Federation on Antimonopoly Violations, FAS Russia fined "Znamya" Moscow Machine-Building Plant" OJSC 1,185,390 Rubles for abusing market dominance on the market of aviation equipment.

"Znamya" Moscow Machine-Building Plant" OJSC disagreed with the decision of the antimonopoly authority and filed a lawsuit; however, the Court confirmed legitimacy of the actions undertaken by FAS Russia.

On 21st February 2010, the Cassation Court dismissed the cassation appeal "Znamya" Moscow Machine-Building Plant" OJSC from the rulings of the Court of First Instance and the Appeal Court. Earlier the Moscow Arbitration Court and the 9th Arbitration Appeal Court dismissed the claim of "Znamya" Moscow Machine-Building Plant" OJSC on invalidating the FAS Russia's determination.
