OREANDA-NEWS. March 25, 2010. On 19th March 2010, the Moscow Arbitration Court confirmed legitimacy of the decision of the Federal Antimonopoly Service (FAS Russia) regarding "Molnia" Chelyabinsk Clock Works" OJSC and dismissed the claim of "ROSTVERTOL" OJSC.

In July 2009, FAS Russia terminated a case against "Molnia" Chelyabinsk Clock Works" OJSC, which had been initiated upon a petition of "ROSTVERTOL" OJSC to the signs of violating Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition".

"Molnia" Chelyabinsk Clock Works" OJSC is the only manufacturer of АChS-1МК aviation clocks used in Мi-28N helicopters and has dominant position on the relevant market.

According to the petitioner, "Molnia" Chelyabinsk Clock Works" OJSC, that has dominant position on the market of aviation clocks, violated the antimonopoly law by evading a contract with "ROSTVERTOL" OJSC for supplying АChS-1МК aviation clocks.

Investigating the case, FAS Russia was unable to verify the fact of refusal by "Molnia" Chelyabinsk Clock Works" OJSC to conclude a contract with "ROSTVERTOL" OJSC for supplying АChS-1МК aviation clocks. The Commission established that "Molnia" Chelyabinsk Clock Works" OJSC was shipping the above products to "ROSTVERTOL" OJSC, registering all documents required by the civil law.

As the fact of violating the antimonopoly law by "Molnia" Chelyabinsk Clock Works" OJSC was not substantiated, FAS Russia terminated the proceedings.

"ROSTVERTOL" OJSC disagreed with the decision of the antimonopoly authority and filed a lawsuit; however, the Court confirmed legitimacy of the FAS Russia's decision.
