OREANDA-NEWS. August 11, 2011. Sverdlovsk Regional Arbitration Court pronounced legitimacy of the fines for the total amount over 5 million Rubles imposed by the Office of the Federal Antimonopoly Service in the Sverdlovsk Region (Sverdlovsk OFAS Russia) upon “PM-Consult” Managing Company” Ltd. (“Monetka” Trading Network) for violating the law on trade, reported the press-centre of FAS Russia.

On 22nd June 2011, Sverdlovsk OFAS Russia found that “Monetka” Trading Network committed administrative violations under Part 4 Article 14.42 the Code of the Russian Federation on Administrative Violations.

On 12th April 2011 and 11th May 2011, Sverdlovsk OFAS Russia initiated five administrative cases against “PM-Consult” Managing Company” Ltd. (“Monetka” Trading Network).

The cases were initiated upon establishing the fact of “Monetka” Trading Network violating Part 4 Article 14.42 the Code of the Russian Federation on Administrative Violations.

In contracts for supply of food products with five suppliers (a branch of “Kachkanar Bread Plant” State Unitary Enterprise – “Agency for Developing Food Product Market”, “Sverdlovsk Bread and Macaroni Plant” OJSC, “Pervouralsk Bread Works” OJSC, “PREMIER-SK” Ltd. and “Krasnoturyinsky Bread Works” Municipal Unitary Enterprise) the Trading Network prohibits to change persons liable under the contracts by assigning the claim. “Monetka” Trading Network also violated the law by establishing civil law liability for failure to observe the above prohibition - 50% of the monetary claim assigned to a third person upon each fact of such establishing.

On each of the five administrative cases, Sverdlovsk OFAS Russia fined “PM-Consult” Managing Company” Ltd. (“Monetka” Trading Network) one million Rubles, which in total amounted to five million Rubles.

Firstly, Sverdlovsk OFAS Russia was one of the first regional FAS offices to apply the norm of the Code on Administrative Violations that imposes sanctions it market the beginning of positive judicial practice on such cases”, commented the Head of Sverdlovsk OFAS Russia Ms. Tatiana Kolotova.
