OREANDA-NEWS. February 06, 2013. The Commission of the Federal Antimonopoly Service (FAS Russia) completed investigating an antimonopoly case against “Elektroavtomat” OJSC (Alatyr) (fixing different prices for the same goods – Clause 6 Part 1 Article 10 of the Federal Law “On Protection of Competition”) and terminated the case due to absence of the violation, reported the press-centre of FAS Russia. 

“Elektroavtomat” OJSC specializes in manufacturing small-sized switching and protective apparatus for aviation equipment, products for electric engineering, radio-electronics, electric power industry, machine-building, car manufacturing, machine-tool industry, medical equipment and other industries.

The case was initiated upon a complaint of “Co Jet” CJSC and “Aviapharm” CJSC that “Elektroavtomat” OJSC had fixed different prices for the products, including the products supplied as part of government defence contracts.

At the same time, in the course of the case investigation, “Elektroavtomat” OJSC and the product buyers submitted documents refuting the arguments indicated in the complaint of “Co Jet” CJSC and “Aviapharm” CJSC. FAS has established that the company sells the products in accordance with the orders on fixing the same wholesale prices for all customers.

The offers for supplying products of “Elektroavtomat” OJSC at the ex-works prices and lower prices by sales organizations are the consequences of the clearance of the remaining products acquired in the previous period at lower prices.

Governed by Clause 2 Part 1 Article 48 of the Federal Law “On Protection of Competition”, the FAS Commission shall terminate antimonopoly cases in the absence of violations of the antimonopoly law in actions (omissions) investigated by the Commission.
