OREANDA-NEWS. November 11, 2013. “The Code of Conduct of car manufacturers will enable reducing the risks of anticompetitive practices on the market. The most important now is that the Code starts working”, said Igor Artemiev at a meeting with representatives of Car Manufacturers Committee of the European Business Association (EBA) on 6th November 2013.

Participants discussed development of self-regulation of the markets of sales of new cars and spare parts and the Code of Conduct of car manufacturers and distributors.

The Code of Conduct of car manufacturers and distributors on the markets of sales of new cars and spare parts for them is devised by EBA and FAS to prevent discrimination in sales of cars and spare parts. The Code determines the main principles of cooperation of car manufacturers and distributors with dealers and independent service stations. FAS agreed upon the draft Code in August 2013.

The Head of FAS Department for Control over Industry and Defence Complex, Maxim Ovchinnikov, pointed out that to efficiently enforce the principles of the Code and develop self-regulation on the market it would be necessary to form a body for pre-trial review of disputes between car distributors, official dealers and independent service stations. He added that “this mechanism of self-regulation will make a precedent in Russia”.

Representatives of FAS and EBA discussed the issues of enforcement and development of the antimonopoly law in regulating vertical agreements between market participants and concluded that there would be no need to pass special normative legal acts on regulating the markets for sales of new car and spare parts for them.

Participants made a decision to control and monitor enforcement of the Code of Conduct of car manufacturers prepare a report on the first results for the Head of the Government Commission on Competition and Developing Small and Medium Business, Igor Shuvalov.
