OREANDA-NEWS. January 28, 2014. The Federal Arbitration Court of the Moscow District pronounced legitimacy of publishing information on 12th December 2011 at the FAS official web-site www.fas.gov.ru that the materials of a case on violating the antimonopoly law on the market of soft cable compounds had been forwarded to the law enforcement bodies.

Earlier “Caustic” OJSC filed a lawsuit to Moscow Arbitration Court to recognize that data published at the FAS official web-site did not represent facts and discredited its business reputation. In particular, FAS published information on its official web-site that the materials of the antimonopoly case had been transferred to the law enforcement bodies and the heads of chemical companies might be held administratively liable.

Having examined the case, on 18th April 2013 Moscow Arbitration Court established that the data challenged by “Caustic” OJSC corresponded to the facts. On 9th August 2013, the 9th Arbitration Appeal Court upheld the judgment. Thus, Courts of three Instances confirmed legitimacy of the actions undertaken by FAS.

“The antimonopoly authority constantly informs the general public about effected events and activities according to the approved information policy of FAS Russia. It is one of the elements of competition advocacy”, said the Head of FAS Anti-Cartel Department Andrey Tenischev.
