OREANDA-NEWS  The Russian Government has developed an addendum to the draft law on the identification and elimination of illegal landfills. This is reported by Vedomosti with reference to the text of the draft.

The new version of the bill divides the powers of municipal and regional authorities in the fight against illegal landfills. According to the draft, local governments should look for unauthorized landfills in populated areas. Outside of localities, the search is entrusted to the regional authorities.

The bill also defines those responsible for the liquidation of the landfill. It should be cleared by those who created it and/or by the owners, land users and tenants of the sites where the accumulation of garbage has occurred. The landfill can also be removed by the local self-government or regional authorities. This is possible if those responsible for its creation did not respond to the demand to eliminate it within 30 days, or if it was not possible to establish who organized the dump.

It is also noted that the authorities that have removed the garbage have the right to demand compensation from those responsible for the accumulation of garbage — the creators of the landfill or the owners of the lands on which it turned out to be.

Currently, there are no clear mechanisms in the legislation to identify and eliminate unauthorized landfills, Dmitry Motorin, senior associate in the environmental field at Vegas Lex law firm, said. According to him, most often they begin to be removed only after the "initiative" of Rosprirodnadzor or the prosecutor's office.

If adopted, the law will enter into force on January 1, 2025. According to Rosprirodnadzor, as of January 1, 2022, more than 15 thousand unauthorized landfills were found in Russia.

Earlier, experts from the Environmental Protection Agency (EA) studied methane emissions from landfills and concluded that landfills harm the planet much more than previously thought. Experts have found that uncontrolled gas emissions occur due to the decomposition of organic waste and leaks of containers in which methane should accumulate.
