Russia has defined a new approach to cases of treason

OREANDA-NEWS The Supreme Court of Russia has made recommendations to lower authorities on the imposition of penalties for treason, indicating that mitigating circumstances should not be taken into account under certain conditions. This is reported by RIA Novosti with reference to the review of judicial practice of the Armed Forces.
To form a new approach to the consideration of criminal cases concerning damage to the security of the country, materials were used against a Russian citizen who received five years in prison for cooperation with the Security Service of Ukraine (SBU), while Article 275 of the Criminal Code of the Russian Federation ("Treason") provides for a sentence of 12 to 20 years up to up to life imprisonment.
According to the investigation, the man, on the instructions of the SBU, called on Russian servicemen to surrender with weapons and military equipment in exchange for a reward, and he also collected their personal data for transfer to Ukrainian intelligence. When sentencing, the court took into account the young age of the accused, his admission of guilt, remorse and cooperation with the investigation, so the Russian received a sentence below the lowest limit.
The prosecutor protested the verdict, considering it excessively lenient. He pointed out that the defendant had committed an encroachment on Russia's security during a special military operation in an effort to make money. After examining the circumstances, the Supreme Court came to the conclusion that not any mitigating circumstances can be taken into account when imposing punishment, but only those that significantly reduce the degree of public danger of the crime. Now other courts should be guided by this example when making decisions and ensure uniformity of judicial practice.
As a result of the review of the case, the Russian, whose case served as an example, received 12 years in prison.
The Presidium of the Supreme Court approved the first review of judicial practice under the chairmanship of the new Chairman Igor Krasnov.
