In Russia was proposed punishing those who save on freight transportation

OREANDA-NEWS The transfer of freight transportation in Russia to electronic document management (EDI) has led to the fact that bona fide market participants lose out to competitors who use gray schemes and are able to offer their services cheaper. This is stated in a letter from the Avtogruzex association to Deputy Prime Minister and Finance Minister Anton Siluanov, Kommersant reports.
To correct the bias, the head of the association, Vadim Filatov, proposed punishing customers of such cargo transportation by depriving them of the right to receive a deduction from income tax on transportation costs.
We are talking about changing Article 270 of the Tax Code. It is proposed to supplement it with a provision linking the recognition of expenses with the availability of mandatory registry information and the state information system of electronic transportation documents (GIS EPD).
To protect companies that have used the gray scheme by mistake, Avtogruzex suggests not punishing them if they checked the information through an electronic service before ordering and saved a screenshot on the appropriate date. In this case, neither a failure on the part of the GIS EPD or the EDI operator, nor a document unsigned by another participant in the transportation will become grounds for non-recognition of expenses.
The association emphasizes that verification should be free, instant and provide a stored result, otherwise large customers will refuse to work with individual entrepreneurs and small firms. Filatov promised that, if necessary, he could provide anonymized examples in which bona fide carriers who fulfilled all requirements suffered losses due to shady players.
Tatiana Patuzhnaya, co-founder of SIGMA logistics company, pointed out that the Avtogruzex initiative closes the existing legal gap. In the current format, all the risks and problems of transition fall on cargo carriers, while service customers have the opportunity to turn to the gray market and not bear any responsibility.
However, VIG Trans founder Igor Rebelsky called the introduction of stricter regulations in the Tax Code in relation to customers premature. He recalled that large companies had faced shadow transportation before, but somehow managed to cope with such competition without additional punitive conditions.
