OREANDA-NEWS. March 31, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that "Inter Finance Technologies" Ltd. violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position), reported the press-centre of FAS Russia.

The case was processed upon a petition of the Association of River Ports and Ship Owners.

"Inter Finance Technologies" Ltd. violated the law because the company had infringed the interests of ship owners by including new services on mooring security protection into the Contract of Service.

By № 847-r Instruction of 21.06.2005, the Federal Agency for the Administration of Federal Property transferred the building of the Severny River Boat Station and 17 passenger piers, classified as federal property, into economic management of the "Resource" Federal State Unitary Enterprise.

In its turn, "Resource" transferred the property of the Severny River Boat Station, including the Station building and the passenger piers, for the use by "Inter Finance Technologies" Ltd.

Thus, "Inter Finance Technologies" Ltd. was granted the right to offer its services to the ship owners.

In July 2006, "Inter Finance Technologies" Ltd., along with the services for pier use, began offering the so-called services on mooring security protection (security supervision).

Processing the case, FAS Russia established that that the second contract effectively duplicated conditions of the contract for the pier use. As for the services on mooring security protection (security supervision), it is not specified in the existing statutory provisions, it has no contract subject and does not ascertain responsibilities of the offering party.

Such a practice of contractual commitment leads or can lead to infringement of the interests of counteragents.

"Inter Finance Technologies" Ltd. has the dominant position on the market of servicing passenger ships in all piers in Moscow and the Moscow region.

Having considered the case, FAS Russia recognized that "Inter Finance Technologies" Ltd. violated the antimonopoly legislation and issued a determination to eliminate the violations.
