OREANDA-NEWS. December 29, 2008. The Federal Antimonopoly Service (FAS Russia) initiated a case against "Voenno-Promyshlennaya Kompania [Military-Industrial Company]" CJSC ("VPK" CJSC), "Santrade Limited" and "Vistafin Companii Limited" for violating Part 2 Article 11 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

"VPK" CJSC is involved in management of financial - industrial groups and holding companies, and consulting on the issues of commercial operations and management.

"Radiophisika" OJSC is mainly involved in research and development for designing new types and models of equipment in special and dual-purpose radio electronics, telecommunications, navigation, communications, computer technologies, as well as for the use in national economy.

FAS Russia considers that "VPK" CJSC, members of the Boards of Directors of "VPK" CJSC, "Santrade Limited" and "Vistafin Companii Limited" violted the antimonopoly legislation by engaging in concerted actions that result or may result in restricting competition.

Earlier FAS Russia, governed by Clause 5 Part 23 Article 33 of the Federal Law "On Protection of Competition", dismissed the petition of "VPK" CJSC on buying 72.6% of voting shares of "Radiophisika" OJSC.

Documents, submitted to FAS Russia with the petition, contained incorrect information regarding the rights of "VPK" CJSC over "Radiophisika" OJSC. This information was important for making a decision by the antimonopoly authority with regard to the petition.

Furthermore, having studied the petition materials, FAS Russia found that "Vistafin Companii Limited" violated the Federal Law "Procedures for Foreign Investments in the Business Entities of Strategic Importance for Russian National Defense and State Security".
