OREANDA-NEWS. December 01, 2009. FAS Russia terminated the proceedings against "Tymlatsky Fish Factory" Ltd., "Zvezda" Fishing Collective Farm, "Olyutorsky Fish Factory" CJSC and "Reftrans" Ltd. initiated upon the signs of violating Part 2 Article 11 of the Federal Law "On Protection of Competition" (bid-rigging) вdue to the absence of antimonopoly violations, reported the press-centre of FAS Russia, reported the press-centre of FAS Russia.

Initially it was suspected that companies were involved in big-rigging practice in course of a tender, organized on 17th April - 1st June 2008, for providing fishery grounds for commercial fishing in the Kamchatka region.

The FAS Russia Commission arrived to a conclusion that the fact of the antimonopoly violations could not be recognized in the absence of direct evidence of the collusion.

Following the decision, FAS Russia will forward to the Government of the Russian Federation its proposals about amendments to the existing normative legal acts that regulate the procedures for allocating fishery grounds. The materials will also be forwarded to the Department of Economic Security of the Ministry of the Interior and the Federal Fishery Agency to make decisions within their scope of reference.

The antimonopoly bodies have repeatedly discovered bid-rigging practices.

On 6th October 2009, the Altai Regional Office of the Federal Antimonopoly Service (OFAS Russia) established the fact of collusion between eight bidders in relation to a vegetable supply contract.

On 14th October 2009, the Tyumen OFAS Russia discovered a bid-rigging collusion between "SibUniversal" PKF" Ltd. and "Atlantis" Ltd. As a result of the bid-rigging, the auction brought minimum saving to the Tyumen regional budget. The government contracts were signed at only 0.5 % below the initial maximum price.

On 2nd November 2009, the Sverdlovsk OFAS Russia pronounced that bribing other bidders by the auction winner was a bid-rigging collusion. The Sverdlovsk OFAS Russia issued a determination to "Agroremstroi" Ltd., "Monolitstroi" Ltd. and "SPSMU-30" Ltd., requesting that in the future the companies must not enable concerted actions leading to not participating in competitive bidding.

On 11th November 2009, the Khabarovsk Office of the Federal Antimonopoly Service (OFAS Russia) found that concerted Actions of "Avis-Amur" Airlines" Ltd. and "Vostok" Airlines" OJSC were in breach of Clause 2 Part 1 Article 11 of the Federal Law "On Protection of Competition" (bid-rigging collusion).
