OREANDA-NEWS. March 14, 2012. OJSC MMC Norilsk Nickel (hereinafter – MMC Norilsk Nickel or the Company) announces that a session of  Supreme Arbitration Court of Russian Federation rejected Rusal’s request to transfer case No.A33-268/2011 from the Arbitration Court of Krasnoyarsk Territory to the Presidium of the Supreme Arbitration Court for a supervisory review, reported the press-centre of Norilsk Nickel.

This way Supreme Arbitration Court of Russian Federation rejected Rusal’s attempt to invalidate the resolutions of the Board of Directors of MMC Norilsk Nickel of 28.12.2010 on termination of the Company’s participation in OJSC OGK-3 and approval of swapping OJSC OGK-3 shares for OJSC INTER RAO UES.

Rusal once again failed to challenge the resolution of the Board of Directors. MMC Norilsk Nickel welcomes the decision of the Supreme Arbitration Court of Russian Federation since it additionally confirms that Rusal’s claims are primarily aimed at destabilizing the situation in the Company. MMC Norilsk Nickel intends to continue defending its interests in courts in accordance with the legislation.
