OREANDA-NEWS. August 12, 2013. President of Ukraine Viktor Yanukovych signed an instruction on the improvement of legislative regulation of the issues related to the utilization of means of transport, payment of the environmental tax for recycling of obsolete vehicles and guarantees of economic interests of owners of such vehicles.

Under the document, Prime Minister Mykola Azarov must ensure elaboration and submission in due course for consideration of the Verkhovna Rada of the draft laws on amendments to the Tax Code and other legislative acts. The Government must ensure protection of rights and economic interests of the owners who submit their means of transport for utilization, particularly in the context of compensation of their value.

The Head of State emphasizes the necessity to eliminate excessive requirements for entities that intend to dismantle vehicles utilized, particularly, the requirement for the presence of series 1400 certified under the standards of the International Organization for Standardization (180) or under similar national standard in specialized areas of environmental management system.

Also, the Prime Minister is instructed to determine the mechanism of precise state control in the sphere of economic activity on recycling means of transport under the Law “On Principles of State Supervision (Control) of Economic Activity”.

Moreover, the order of the use of money received from the environmental tax for recycling must be determined.

Under the document, the Government must eliminate provisions that do not comply with international obligations of Ukraine undertaken in the process of accession to the WTO. Particularly, these are provisions on characteristics of entities producing means of transport and undertaking the obligation to recycle obsolete means of transport in the order and under conditions determined by the law on utilization of obsolete means of transport. Also, these are provisions under which such entities are exempt from environmental tax for recycling obsolete vehicles.
