OREANDA-NEWS. June 16, 2014. The Federal Antimonopoly Service (FAS Russia) found that the Inter-Regional Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District violated Part 3 Article 15 of the Federal Law “On Protection of Competition”.

In the course of the case investigation, the FAS Commission established that the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District concluded an agreement on cooperation and information exchange with the operator of navigation-and information system in the Stavropol region – “RNITs SK” OJSC and assigned to it a function of a government body - the function for testing subscriber telematic terminals installed in vehicles of carriers under No. 285, No.20 Orders of the Ministry of Transport of the Russian Federation.

In accordance with an oral agreement with the Government of the Stavropol region, “RNITs SK” OJSC had the right to receive monitoring information for all vehicles exercising passenger commercial transportation and carriage of hazardous goods in the Stavropol region, for further transmission of collected information to the Automated Control and Supervision Centre, of the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District.

Thus, the Government of the Stavropol region gave “RNITs SK” OJSC the status of a regional operator of the navigation-and information system in the Stavropol region without selection procedures, in breach of Clause 4 Article 16 of the Federal Law “On Protection of Competition”.

According to the information available to FAS, the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District also avoided concluding similar agreements with other economic entities and jointly with “RNITs SK” OJSC prevented access to the market of services for transmitting monitoring data the Automated Control and Supervision Centre, of the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District and did not test subscriber telematic terminals of carriers.

“FAS terminated the proceedings against the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District and “RNITs SK” OJSC under Clause 4 Article 16 of the Federal Law “On Protection of Competition”. It was established that the Office of the Federal Service for Transport Supervision in the North-Caucasian Federal District was guided by mandatory instructions of the Federal Service for Transport Supervision”, concluded Deputy Head of FAS, Alexei Dotsenko.
